Pension Rules framed under para 42 of A.T.P.P.F  & P.F. Scheme, 1968 and approved by the Govt. of Assam vide memo No. GLR. 263/70/44, dt. 12-7-1972.

Pension Including Family Pension through
Assam Tea Plantations Provident Fund
And Pension Fund Scheme
For the Tea Workers in Assam.

            The Board of Trustees, Assam Tea Plantations Provident Fund and Pension Fund Scheme under the direction of Govt. of Assam have decided to introduce Family Pension Scheme for the workers of Tea plantations in Assam. It has also been decided to increase the existing Pensionary benefits at a much enhanced rate. These benefits will be in addition to the Provident Fund an Insurance now being enjoyed by them. The revised Pension Scheme including Family Pension shall come into force with effect from 1-4-1972.
2. The Revised Pension Scheme is proposed to cover the cases of Pension/Family Pension to all the members of the Assam Tea Plantations Provident Fund Scheme on retirement, premature cessation and family pension to their families on death while in service.
3. Pensionary benefits must need be related to :
            (i) Age on retirement,
(ii) The minimum period of membership in the Provident Fund,
(iii) Provident Fund accumulation on the date of retirement.
The age of retirement has been fixed at 58 years.
The minimum qualifying period of membership in the Fund has been fixed at 25 years without any break for more than 3(three) months at a time for full pensionary benefits. Under the Assam Tea Plantations Provident Fund (Assam Act X of 1955) an employee in a plantation is compulsorily require to be a member of the Provident Fund. By linking entitlement to pension to membership of Provident Fund, cases of transfers from one garden to another will be covered. The pensionary benefits proposed to be given has been related to members wages as reflected in the Provident Fund contributions made by him to the Fund.  Thus a member being a member of the Provident Fund for 30(thirty) years will have a larger amount of pension than on putting in fewer years of membership in the Fund.

3.(a) Family Pension :
          Family Pension as detailed in para 5© shall be given to the family, as indicated below, of a member who dies while in service, subject to completion of full one year of membership of the Fund.
The Family Pension is Payable to :
(i)To the widow or widower upto the date of death or remarriage whichever is earlier.
Provided that no widower who adopted bigamy or polygamy can claim family pension except for the wife who dies first.
Provided further that in the event of a male member who adopted bigamy or polygamy, only one family pension shall be payable to all the surviving widows in the equal shares.
(ii) Failing (i), to the eldest son until he attains the age of 18 years.
(iii) Failing (i) and (ii), to the next eldest son until he attains the age of 18 years and
(iv) Failing (i), (ii) and (iii), to the eldest unmarried daughter until she attains the age of 21 years or marriage whichever is earlier.
Family Pension shall become payable from the beginning of the month immediately following the month in which the members dies.
4. The pension Fund :
          It shall consist of :

  1. Opening balance of the existing Pension Fund as on 1-4-1972.
  2. Annual contribution from the Surplus Interest Account.
  3. Annual contribution by the Central Government.

5.(a) Pensionary benefits to a member who retires at the age of 58 years or more shall be apportioned

In case of termination of membership

(In determining the age and period of membership of the broken period of 6 months or more will be counted as completed period of one year. The broken period of less than 6 months will be ignored).

5.(c) Family Pension in the event of death of a member while in service  :-
          A lump of Rs. 2000/- (Rupees two thousand only) and a monthly family pension as indicated below will be given to the members of the family as indicated in para 3(a) of the member who dies while in service, having put in one year of continuous membership of the Fund :-

6. Facility for Commutation :
          A member retiring on attaining the age of 58 years may have the privilege of commutation of the total pension admissible to him at a time on retirement. The commuted value will be 75% of the total pension.

6.  (a) Change of option to receive commuted value in lieu of monthly/yearly pension  :
          The application for change of option to receive commuted value in lieu of monthly or yearly pension is to be made within one year from the date of admittance of the claim and thereafter no application for change of option shall be entertained.

7.  Option to receive Revised Pension in lieu of Family Pension  :
          A person entitled to draw family pension as per para 3(a) herein before mentioned may opt for revised pension in lieu of family pension. Pensionary benefits in such cases shall be payable as per provisions of para 5(a), 5(b) and 6 of this booklet.

7.  (a) In no case a retired member or a nominee of a deceased member shall be entitled to claim both the Family Pension and Revised Pension.
8.  Proof of age and records of service  :
          Each plantation shall maintain the records of age and membership in the Provident Fund of all the employees. These  records shall
be made available to all officers of this office for inspection . While forwarding pension application, the garden mandent Fund accumulation of the member concerned.
9.  Procedure of application for pension/Family Pension :   

            The application for  pension in prescribed form shall be submitted by each applicant whether full time retirement to his / her employer . The employer in hi turn shall certify on the application the correctness of the age, membership in The fund and the last provident Fund balance and forward the same along with a true copy of the settlement Receipt to the respective Pension Wing of Assam
Tea Plantations Provident Fund and Pension Fund Scheme for onward action. The form of application for pension is shown in Appendix IV .The procedure of application for family pension shall be the same as in case of pension , but the application form will be different as shown appendix IV (a) and (b).
9. (a) Anybody desirous for alteration of the particulars furnished in the original Pension /Family Pension application must do so by submitting an application within one month from the date of admittance of the claim . Such application must be submitted through the garden Manager .
10.       Last Provident Fund balance of Retiring / Deceased Member :
            Last Provident Fund balance shall mean the net amount actually paid off  to the retiring member or his/her nominee in case of the deceased member after deducting all the outstanding advance payable by a retiring/deceased member.   
11.       (a) Mod of payment :
            Pension shall be payable either monthly or yearly or 75% of the total pension  (    th commuted value) at a time at the option of the beneficiaries .
11.       (b) Pension and other associate benefits shall be paid at half the rate of usual benefits in case of those who are dismissed, discharged, for gross misconduct as defined in the Assam Tea Plantations Provident Fund and Pension Fund Scheme.
11.       (c) Where a retired/ceased member of the Fund to whom any amount has become payable under para 5 (a) and (b) of the booklet dies before the amount has actually been paid to him the amount shall be payable to his/her nominee.
11.       (d) Disbursement of pension money shall be made by the employer or his authorised agent within one month from the date of remittance and undisbursed amounts shall be deposited into any branch of State Bank of India / United Bank of India for credit of Account
No 9 of A.T.P.P.F.& P.F. Scheme by Challan in quadruplicate immediately thereafter .
11.       (e) It shall be the responsibility of every employer to maintain records showing disbursement of amounts of pension received from
The Board of Trustees.
12.Redeeming Features of the Scheme :
The Scheme has the following redeeming features :

  1.       No direct contributions either from the employers or the employees.
  2.       The benefits are in addition to the Provident Fund and Insurance benefits.
  3.       This will encourage the spirit of saving and will be Inspire maintenance of handsome Provident Fund credit balance . It will discourage frequent drawal of advances from Provident Fund and absenteeism . 

 
13.       Cost of Administration :
            The cost of administration of the Scheme will be borne by Government of India and remittance can be despatched to the garden managers and the members concerned from pay offices to be established in parts of the state .
14.       Invalid pension :
            A monthly pension of  Rs.60/ - (Rupees sixty ) will be given to a P. F. member for life who sustains injuries while in service resulting in permanent total disablement as provided in Schedule I part No. 1 of Section 2 (1) and 4 of the Workman’s Compensation Act, 1923 . Such invalid pension shall be payable to the members who sustain injuries of the undernoted description .

14. (a) The application for invalid pension shall be submitted by the member through his/her employer in the prescribed form shown in Appendix V. Such application must accompany a certificate from the Doctor of the Tea Estate concerned disclosing the description of injury making him/her permanently total disablement for any work.

14. (b) Such invalid member shall have the option to go for revised pension in lieu of invalid pensions according to his/her advantage.

14. (c) The above benefit is in addition to the compensation payable by his/her employer as provided under Workmen’s Compensation Act, 1923 as amended.
